Command Review Board Concludes Officer Involved Shooting was Justified

Chief Anthony Holloway convened a Command Review Board on December 5th to review the officer involved shooting that occurred on September 12th. The Office of Professional Standards had concluded an investigation into whether K9 Officer Stephen York had violated any Police Department policies and/or City of St. Petersburg rules and regulations. The Board determined that Officer York's actions were justified and no policies were violated.

Last month, the Pinellas County Use of Deadly Force Investigative Task Force investigated the shooting and concluded K9 Officer York's actions were lawful under the circumstances. A separate and independent investigation conducted by the Sixth Judicial Circuit Office of the State Attorney also determined that the officer lawfully shot and killed Cody Kiley while in the lawful performance of his duties.

Summary:
On September 12, 2022, K9 Officer Stephen York responded to 4533 20th Avenue North, St. Petersburg, regarding a man with a gun. The suspect, Cody Kiley, had threatened to kill his mother with a gun prior to police arrival. K9 Officer York encountered the armed suspect in the backyard of the residence. The suspect failed to comply with several commands to place his hands on his head and drop the gun. K9 Officer York deployed his canine, Loki, and the suspect still did not drop the gun and began to struggle with the dog. Fearing for his life and the life of his K9, Officer York then discharged his firearm at the suspect. The suspect succumbed to his injuries.
